Acceptance of terms
These Terms & Conditions ("Terms") govern your use of the websites and services of TDG Resource Management LLC, doing business as The Dillard Group Realty & Management ("TDG," "we," "us," or "our"). By accessing or using our services, you agree to these Terms. If you do not agree, do not use our services.
Use of our services
You agree to use our websites and services only for lawful purposes and in accordance with these Terms. You may not misuse the services, attempt to gain unauthorized access, or interfere with their operation.
SMS / text messaging terms
TDG operates an internal, non-marketing SMS program under the brand TDG Tracker for onboarded team members — staff, contractors, and project personnel. The program uses a double opt-in: an authorized administrator may request consent during onboarding, and you opt in by replying YES to a confirmation text from your own device. No operational messages — task assignments, reminders, and completion confirmations — are sent until that YES confirmation is received.
Consent and opt-out
Consent is the team member’s own YES reply and is not a condition of employment or engagement. You may decline by replying STOP, opt out at any time by replying STOP, and reply HELP for help. Full opt-in details are in our SMS Messaging & Consent Policy.
Frequency and rates
Message frequency is approximately 1–10 per week, varying with project activity. Message and data rates may apply, depending on your mobile carrier and plan. We do not sell or share mobile phone numbers or SMS opt-in data with third parties for marketing. See our Privacy Policy for details.
Carrier disclaimer
Mobile carriers are not liable for delayed or undelivered messages.
Intellectual property
The content, logos, and materials on our websites are owned by or licensed to TDG and may not be copied or used without permission, except as permitted by law.
Disclaimers and limitation of liability
Our services are provided "as is" without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, TDG is not liable for indirect, incidental, or consequential damages arising from your use of our services.
Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Los Angeles County, California.
Changes to these terms
We may update these Terms from time to time. Changes take effect when posted, and the effective date above will be updated accordingly.
